Terms of Service

The terms under which Folded Petal sells subscriptions, originals, and commissions.

1. About these terms

These Terms of Service ("Terms") govern your use of www.foldedpetal.com and the products and services offered by Joydeer Limited, a private company limited by shares incorporated in Hong Kong (Company No. 78997328), with registered office at Room D07, 8/F, Kai Tak Factory Building, No. 99 King Fuk Street, San Po Kong, Hong Kong ("Folded Petal", "we", "us").

By placing an order or subscribing, you accept these Terms. If you do not accept them, please do not use the service.

A copy of these Terms together with your order confirmation will be sent to you by email at the time of purchase, on a durable medium so that you may store, retrieve, and print them at your convenience (UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, reg. 16; EU Consumer Rights Directive 2011/83/EU, art. 8(7)).

2. Who can subscribe

You must be at least 18 years old (or the age of majority in your country, whichever is greater) to place an order. By subscribing, you confirm that the address you provide is one at which you are legally able to receive international mail.

3. The Mail Club subscription

The Folded Petal Mail Club is a monthly recurring subscription at $14 USD/month or $140 USD/year (a saving of approximately 17%). Each issue contains:

  • one printed watercolor postcard from a hand-painted original,
  • three or four hand-cut paper stickers,
  • a folded handwritten letter.

We reserve the right to reasonably vary the contents of any given issue, provided overall value and quality are maintained.

4. Billing & renewal

  • Subscriptions renew automatically on the same calendar day each month or year.
  • Payments are processed by Stripe. We never see or store your full card number.
  • You may cancel anytime through the Stripe Customer Portal link in your billing email. Cancellation takes effect immediately, but you will still receive any issue already prepared for shipping in the current cycle (no refund for the partial period).
  • Annual subscribers may cancel anytime; we do not offer prorated refunds for annual cycles, except where required by law (see Refund Policy).
  • Cancellation is as easy as sign-up. Because you signed up online, you can cancel online — through the Stripe Customer Portal, in one step, with immediate effect. No phone call, retention agent, or "save offer" stands between you and cancellation. This commitment reflects our policy and the FTC Negative Option / Click-to-Cancel Rule (16 C.F.R. § 425) for U.S. customers.

Prices, taxes, and customs

  • All prices are quoted in United States Dollars (USD) and are inclusive of any sales tax we are required to collect in Hong Kong (currently none — Hong Kong does not levy a GST/VAT on the supply of services or goods exported overseas).
  • We do not collect or remit VAT, GST, sales tax, or import duties on behalf of your country. Where applicable, your local postal service or customs authority will assess any taxes or duties on the parcel and may charge you a small handling fee. These charges are your responsibility and are separate from the subscription price.
  • For United Kingdom subscribers: parcels under £135 may incur UK VAT (currently 20%) at delivery. For European Union subscribers: under the Import One-Stop Shop (IOSS) rules, parcels below €150 may incur local VAT at delivery; we do not currently use IOSS so VAT is collected by your postal service.
  • Your card statement may show the charge in your local currency at the rate set by your card issuer; the underlying invoice is in USD.

5. Shipping & delivery

  • We ship from Hong Kong via China Post Registered Air Mail (or equivalent tracked service) with full tracking on every issue.
  • Estimated delivery: 6-10 business days for the United States; 10-21 business days internationally, depending on your local postal service.
  • If your envelope has not arrived after 14 business days (US) or 21 business days (international) from the dispatch email, write to us and we will re-mail a fresh copy at our cost. This 14/21-day re-mail guarantee is our customer-protection promise; it does not affect your statutory rights.
  • Customs duties and import taxes are your responsibility. We declare actual contents and value on customs forms.
  • It is your responsibility to keep your shipping address current; we are not liable for issues lost due to outdated addresses.

6. Originals & commissions

Original paintings and bespoke commissions ordered through the site are subject to additional terms communicated by email at the time of order, including:

  • 50% non-refundable deposit before sketch (commissions);
  • Two rounds of revisions at sketch stage;
  • 4-6 week production time depending on size;
  • final balance due before mailing.

Each original is one of one. Once an original is sold or a commission is delivered, it is yours; we do not produce additional copies of the same painting.

7. Intellectual property

All paintings, illustrations, text, photographs, and website design on www.foldedpetal.com are the copyright of Joydeer Limited. Buying a subscription, an original, or a commission grants you the physical artwork and the right to enjoy it personally. It does not grant you the right to reproduce, sell prints of, or commercially exploit the imagery.

You retain copyright in any photos you send us for a commission, and you grant us a non-exclusive licence to use those photos solely for the purpose of producing your commission.

8. Acceptable use

You agree not to:

  • attempt to reverse-engineer, scrape, or interfere with the site;
  • impersonate another person or use the service to send harmful content to staff;
  • use the service in a way that violates Hong Kong law or the law of your country.

We may suspend or terminate accounts that breach these Terms, with refund of any unfulfilled period.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of these Terms is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for indirect or consequential losses (lost profit, missed gifts, etc.).

Statutory rights are not affected. Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • our duty under the UK Consumer Rights Act 2015 (or the equivalent law in your country) to supply goods that are of satisfactory quality, fit for purpose, and as described, and services performed with reasonable care and skill;
  • any loss caused by our breach of the EU Consumer Rights Directive 2011/83/EU, the EU Sale of Goods Directive 2019/771, or any equivalent mandatory consumer-protection legislation in your country;
  • any other liability that cannot lawfully be limited or excluded.

If any limitation in this Section is held unenforceable in your jurisdiction, the remaining limitations continue to apply.

10. Force majeure

We are not liable for delays or non-delivery caused by events outside our reasonable control, including postal disruption, customs holds, natural disasters, war, pandemic, or sustained internet outage. Where such events delay shipment by more than 60 days, you may cancel and receive a refund of the unshipped portion.

11. Governing law & disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising out of these Terms shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong, except where a mandatory consumer-protection law in your country of residence gives you the right to bring a claim in your local courts (which we will not contest).

EU Online Dispute Resolution. If you are a consumer resident in the European Union, you may also use the European Commission's Online Dispute Resolution platform to resolve a dispute out of court: ec.europa.eu/consumers/odr. You may also raise the matter directly with us at hello@foldedpetal.com — we are not currently subscribed to a specific Alternative Dispute Resolution provider but will engage in good faith with any complaint.

California consumers. If you reside in California, you may submit complaints to the California Department of Consumer Affairs, Consumer Information Division, 1625 N. Market Blvd., Suite N 112, Sacramento, CA 95834.

Hong Kong consumers. You may also raise consumer-protection complaints with the Hong Kong Consumer Council.

12. Changes

We may update these Terms from time to time. The "Created" date below reflects the latest revision. Material changes affecting your subscription will be notified by email at least 14 days before they take effect. Your continued use after that date constitutes acceptance of the new Terms.
